Checking Your BV Name: How to Avoid Mistakes When Starting Your Business
11 June 2025

Checking a good BV name is the first step to avoiding hassle, legal risks and confusion among customers. Your company name is not only your calling card, but also a legal foundation of your business. A wrong choice can become expensive in the long run—think trademark infringement, conflicts with competitors or even having to rename your company.

In this article, you’ll discover how to check a BV name in a way that complies with Dutch laws and regulations.

Start with the KvK, but look further

The first logical step in checking a BV name is the KvK Name Checker. This allows you to check whether your desired name already appears in the Trade Register or is too similar to an existing trade name. The Trade Name Act states that you may not use a name that creates confusion with another company in a similar sector or region. Even small adjustments, such as adding an extra letter or using creative spelling, may not be enough to make it distinctive.

Does your name comply with the Trade Name Act?

In addition to being unique, your name must also be legally correct. According to the Trade Name Act, a trade name may not be misleading or give the wrong impression. For example, you may not call your business “& Partners” if you work alone, or use medical or protected terms without the proper right. Names that imitate existing trademarks or use personal names without permission can also cause problems.

Don’t forget Google and social media

A complete BV name check also means checking your desired name via search engines and social platforms. Not every business is registered with the KvK—some use their name only online. This also helps you avoid unwanted associations or duplicate use of a name abroad, which is especially important if you have international ambitions.

Carefully check trademark rights

It’s essential to also check whether your name has already been registered as a trademark. You can do this via the BOIP for the Benelux or the EUIPO for the European Union. Even if your name does not yet appear in the Trade Register, it may still be protected under trademark law. If you want to use the name for branding or product sales, consider registering it as a trademark yourself.

Domain name and digital availability

Once you’re happy with your name, check right away whether the corresponding domain name is still available. You can do this via SIDN.nl for a .nl domain, but other extensions such as .com or .eu can also be valuable. Ideally register your domain name before you register your BV, to prevent someone else from taking it once your name becomes visible in the Trade Register.

Think long-term

A name that fits well today should still be suitable five years from now. Ask yourself whether the name is broad enough to cover future products or services, and whether it will still work if you expand internationally. A future-proof name prevents you from having to start over once your company grows or changes direction.

Conclusion: a smart BV name check is essential

Checking a BV name is much more than a formality—it’s a fundamental part of your brand strategy and legal certainty. By carefully checking trade name rules, trademark rights, online availability and long-term suitability, you lay a strong foundation for your business.
